1. Overview of BulkifySMS Services

BulkifySMS is a messaging platform designed for individuals, small and medium-sized businesses, and large-scale enterprises to send bulk SMS communications for marketing, customer engagement, notifications, and other lawful messaging purposes.

2. Eligibility and Account Responsibility

• You must be at least 13 years old to use BulkifySMS.
• You agree to provide true, accurate, and complete information when creating your account.
• You are responsible for safeguarding your account credentials and for all activities that occur under your account.
• You must notify us immediately of any unauthorized access to your account.

3. Acceptable Use Policy

By using BulkifySMS, you agree NOT to:

• Send unsolicited (SPAM) or fraudulent (SCAM) messages.
• Send misleading, offensive, abusive, defamatory, or illegal content.
• Use fake sender IDs or impersonate any person or organization.
• Modify or hack the BulkifySMS platform.
• Transmit malware, worms, viruses, or destructive code.
• Violate any applicable laws, including copyright or telecom regulations.

4. Wallet Funding, Usage & Withdrawal Policy

• Customers can fund their BulkifySMS wallet with money (local currency).
• Wallet funds are not automatically converted into SMS credits.
• To access SMS credits, customers must purchase a specific SMS plan (Starter, Professional, Enterprise, or Pay-As-You-Go) using their wallet balance.

• Customers may request to withdraw unused wallet funds back to their registered bank account at any time.
• All bank charges, transaction fees, or processing costs incurred during the withdrawal process shall be solely borne by the customer.
• BulkifySMS will process approved withdrawal requests within 3-7 business days, subject to verification and compliance checks.

Note: SMS credits purchased under any plan are non-refundable and cannot be withdrawn as cash.

5. Credit Usage & Expiration Policy

• SMS credits are allocated only upon successful purchase of a plan.
• Credits are deducted based on the number of SMS sent, destination, and message length.

• SMS credits obtained from plan purchases are valid for 30 days from the date of purchase unless otherwise specified in the plan details.

• Any free, promotional, or bonus SMS credits (e.g., from sign-up offers) are valid for 30 days from the date of registration.
• If unused within this period, such credits may automatically expire and be removed from the account.

• Beyond the initial 30-day validity of purchased credits, if a customer’s account remains completely inactive (no SMS sent, no plan purchased, or no wallet top-up) for 12 consecutive months, any unused credits may expire automatically.

• Condition Expiring SMS credits can only be rolled over if a plan renewal or wallet top-up is completed within 24 hours before the expiration date.
• Renewals or top-ups completed 24 hours after credit expiration will not restore expired credits. Expired credits are permanently forfeited.

6. Pricing & Payment Terms

• BulkifySMS offers multiple pricing plans: Starter (with a 7-day free trial), Professional, Enterprise, and Pay-As-You-Go.
• Customers who register but do not purchase any plan and attempt to send SMS after the 7-day free trial will automatically be placed on the Pay-As-You-Go pricing model.
• Under this model, charges for SMS sent will be deducted directly from the wallet balance.

• Policy All payments for SMS plans and services are final, non-cancellable, and nonrefundable — except in cases where SMS delivery failed due to a proven BulkifySMS system error.

• If an error occurs during wallet funding and the customer’s bank account is debited but the BulkifySMS wallet is not credited, customers must contact their bank directly for transaction reconciliation and refund processing.
• BulkifySMS may provide transaction references to assist but will not process refunds for bank-side errors.

7. Service Availability & Limitation of Liability

• BulkifySMS services are provided "AS IS" and "AS AVAILABLE" without any warranty.
• We do not guarantee uninterrupted service or 100% SMS delivery success due to dependencies on third-party telecom providers.

We are not liable for:

• Loss of business, profits, data, goodwill, or any indirect or consequential damage arising from your use of BulkifySMS services.

8. Emergency Service Limitation

BulkifySMS is not designed to support or carry emergency communications to emergency services (such as 911, 112, 419 etc.). You agree not to rely on BulkifySMS for emergency purposes.

9. Modification of Services and Terms

We reserve the right to modify these Terms, our services, pricing, or features at any time with or without notice. Continued use of BulkifySMS after such changes constitutes acceptance of the new Terms.

10. Dispute Resolution

Any dispute arising from these Terms or BulkifySMS services shall be resolved through binding arbitration and strictly on an individual basis. Class actions or group lawsuits are not permitted

11. Assignment

You may not assign or transfer these Terms without our prior written consent. Any attempt to assign in violation of this section is void.
